What
are “compensatory damages”?
Compensatory damages are what you are monetarily
entitled to in a trial, arbitration, mediation, or injury settlement.
These damages are divided into two categories, “special damages” and
“general damages”. Added together, these two categories determine
what amount of money to ask for in your demand letter inasmuch as we
suggest you demand a multiple of your estimated total damages. Let’s
break the categories down by individual components.
Special damages
Special damages includes damages capable of
computation, such as all medical costs, prescription medicine,
over-the-counter medicine, rehabilitation or physical therapy treatment,
lost wages, lost profits, baby sitter costs, maid, nurse, the cost of
transportation to and from the doctors’ offices, and the cost of appliances
prescribed to be worn.
General damages
General damages includes those injuries not capable of
computation, such as pain and suffering, severe emotional distress, loss of
relationship (consortium) with spouse, loss of enjoyment of life, and
interference with normal activities. The last two are sometimes
referred to as “impairment of quality of life”.
