I am writing to confirm our telephone call last Tuesday, November 25th. I just wanted to document our conversation regarding the issue of liability.

When I began to discuss the ways in which I felt your insured was at fault, you stopped me and stated, "That won't be necessary—we aren't going to be contesting liability in this claim."

I want to be sure you understand that based upon your assurance that your company is assuming 100% of the fault in this claim, I will not be developing any information or witnesses to demonstrate the fault of your insured.

If you feel I have misquoted you or otherwise misunderstood what you said, please notify me in writing as soon as practicable. If I do not hear from you within a short time of your receipt of this letter, I will just limit my demand letter presentation and exhibits to proving damages.

I appreciate your conceding liability and believe that this arrangement will allow us to work more productively toward a fair and amicable resolution of this claim without resort to the courts.
